Current Phase: LingoWhales is currently in pre-launch phase. By joining our waitlist, you acknowledge that the platform is not yet fully operational, and you are signing up to be notified when we launch.

LingoWhales is a language learning social media platform that helps users learn languages through immersive content from native speakers. Our platform combines:

• AI-powered learning assistance and translations

• Personalized learning experiences

Waitlist Phase: During the pre-launch waitlist phase, the service is limited to collecting email addresses and preferences for future platform access. No language learning services are currently available.

3. Eligibility

You must be at least 13 years old to use our services. By using LingoWhales, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and truthful information

4. Waitlist Terms

By joining our waitlist, you:

• Understand that waitlist position does not guarantee early access or special features

4.2 No Guarantee of Service

Joining the waitlist does not guarantee:

• Platform access or account creation
• Specific launch timeline or features
• Priority access or beta testing opportunities
• Free or discounted services

4.3 Unsubscribing

You may unsubscribe from the waitlist at any time through our unsubscribe page or by clicking the unsubscribe link in any email we send you.

5. User Conduct and Acceptable Use

You agree not to use our services to:

• Submit false, misleading, or fraudulent information

All content on the LingoWhales platform, including but not limited to:

• AI-generated translations and learning materials
• Branding and trademarks

are owned by LingoWhales or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

6.2 User Content (Future)

When the platform launches, users will be able to post content. At that time, by posting content, you grant LingoWhales a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating and improving our services.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or freedom from viruses or malicious code

We do not guarantee that our platform will meet your specific learning goals or expectations. Language learning outcomes depend on individual effort, practice, and other factors beyond our control.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINGOWHALES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, data loss, or security breaches
• Errors or inaccuracies in AI-generated content or translations
• User conduct or content posted by third parties

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless LingoWhales and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of our services
• Violation of these Terms or applicable laws

• Content you submit or post on our platform
